Terms of Use
1Agreement to these terms
These Terms of Use are a binding agreement between you, whether you act for yourself or for an organisation, and Thursday Media International, which publishes The Thursday Times (“The Thursday Times”, “we”, “us” or “our”). They govern your use of thursdaytimes.com in English and Urdu, Westline, the Thursday Times app, our newsletters and alerts, and any other service of ours that links to them (together, the “Site”).
By using the Site, you confirm that you have read, understood and accepted these Terms. If you do not accept them, you must not use the Site.
Thursday AI has its own terms, which apply in addition to these when you use it. Other terms or guidelines we publish for a particular feature also form part of these Terms.
We may change these Terms from time to time. When we do, we will update the date at the top of this page, and significant changes will be announced on the Site. If you keep using the Site after a change, you accept the new Terms.
Who may use the site
The Site is for general readers. If you are under 18, or a minor where you live, you must have a parent’s or guardian’s permission to use it, and they should read these Terms with you. The Site is not designed to meet the requirements of any particular industry’s regulations, and you are responsible for making sure your use of it is lawful where you are.
2Our content and intellectual property
Unless we say otherwise, everything on the Site, including our journalism, photographs, illustrations, graphics, audio, video, software, design and databases (the “Content”), and our names, logos and trademarks (the “Marks”), belongs to us or is used by us under licence. It is protected by copyright, trademark and other laws in Pakistan and around the world.
You may read, listen to, watch and share the Content for your own personal, non-commercial use. You may print or save a copy of a story for yourself, and you may share links to our stories and quote short extracts with a credit and a link to the original.
You may not copy, republish, broadcast, sell, license or otherwise use the Content or the Marks for any commercial purpose, or reproduce whole stories, photographs or illustrations, without our written permission. For permission to republish, write to pr@thursdaytimes.com.
We keep all rights we do not expressly give you.
3Your promises
By using the Site, you promise that:
- you have the legal capacity to accept these Terms and you will follow them;
- if you are a minor, you have your parent’s or guardian’s permission;
- you will not use the Site for anything illegal or unauthorised; and
- your use of the Site will not break any law or regulation.
If anything you give us is untrue, inaccurate or incomplete, we may refuse or end your use of the Site.
4What you must not do
You must not:
- scrape, crawl or systematically download the Site or the Content, by any automated means, to build a collection, database or service, or to train or feed an artificial intelligence system, without our written permission;
- copy or reproduce the Content in breach of section 2, or remove any copyright or other notice from it;
- frame the Site, or present the Content as if it came from someone else;
- get around, disable or interfere with the Site’s security features, or any feature that limits how the Content can be used;
- upload or transmit viruses or any other harmful code, or spam;
- interfere with, overload or disrupt the Site or the networks and services connected to it;
- pretend to be another person, or misrepresent your connection with anyone;
- trick, defraud or mislead us or other readers;
- use anything you find on the Site to harass, abuse or harm anyone;
- harass, threaten or abuse our journalists or staff;
- reverse engineer any part of the Site, except as the law permits; or
- use the Site to compete with us, or for any commercial purpose we have not approved.
Normal use of search engines and browsers is allowed.
5Comments and other contributions
The Site may let you comment, send us letters or pieces, or otherwise share material (“Contributions”). Contributions may be seen by other readers. When you send us a Contribution, you promise that:
- it is your own work, or you have every right and permission needed to send it and for us to use it;
- you have the consent of any identifiable person in it to use their name or likeness;
- it is not false or misleading;
- it is not spam or advertising;
- it is not obscene, threatening, harassing, defamatory, hateful or abusive, and it does not attack anyone for their race, religion, nationality, gender, sexual orientation or disability;
- it does not invade anyone’s privacy or infringe anyone’s rights; and
- it does not break any law, including laws that protect children.
You keep ownership of your Contributions. By sending one to us, you give us a worldwide, perpetual, irrevocable, non-exclusive, transferable, royalty-free licence to publish, edit, retitle, translate, adapt, excerpt, archive, distribute, sell and license it, with your name and likeness where you have supplied them, in any form and on any platform, now known or developed in future, for any purpose including commercial ones, and to grant others the same rights. To the extent the law allows, you waive any moral rights in your Contributions. Pieces we commission or accept for publication may also be covered by a separate agreement with you, which will take priority over this section.
We may edit, shorten, move, decline or remove any Contribution, at any time and for any reason. We do not have to monitor Contributions, and we are not responsible for what readers post. You are responsible for your own Contributions.
Feedback
If you send us ideas, suggestions or feedback about the Site, we may use them freely, without paying or crediting you.
6Translations, audio and artificial intelligence
Some of our Urdu and other-language versions of stories are translated with artificial intelligence, and many stories can be heard read aloud by a computer-generated voice. We check our work, but machine translations and recordings can contain mistakes. Where a translation or recording differs from the story as written in its original language, the original is the authoritative version.
7Supporting the paper
If you choose to make a payment to support The Thursday Times, it is a voluntary contribution to our journalism. It does not buy goods, a subscription or any special access, and the Site stays free to read either way. Payments are processed by Stripe, JazzCash or Easypaisa, under their own terms. You can stop a monthly contribution at any time by writing to pr@thursdaytimes.com. If a payment was made in error, tell us and we will look into it.
8Newsletters, alerts and the app
Our newsletters, alerts and app are free. You can unsubscribe from any newsletter with the link at the foot of every email, and turn alerts off in your browser or device settings. We may change or stop any newsletter, alert or app feature at any time.
9Advertising
Advertising on the Site is clearly labelled. Advertisers are responsible for their advertisements and for anything they sell through them, and they promise that they have every right needed to place them. We provide the space only. Including an advertisement does not mean we endorse what it offers. To advertise with us, write to ads@thursdaytimes.com.
10Other websites and content
The Site links to other websites and includes material from other services, such as embedded videos and social media posts. We do not control them and are not responsible for their content, accuracy, availability or privacy practices. A link or embed is not an endorsement. If you leave the Site, these Terms no longer apply, and you should read the terms and policies of the site you visit. Anything you buy from another website is between you and that website.
11Privacy
Our Privacy Notice and Cookie Policy explain how we handle your information, and form part of these Terms. The Site is hosted in the United Kingdom, delivered through a global network and run from Pakistan. By using it, you understand that your information will be handled in those places, as the Privacy Notice explains.
12Running the site
We may, but do not have to:
- monitor the Site for breaches of these Terms;
- take legal action against anyone who breaks the law or these Terms, including reporting them to the authorities;
- refuse, limit or remove access to any Contribution or any part of the Site; and
- otherwise manage the Site to protect our rights and property and keep it working.
We may change, suspend or withdraw any part of the Site, or its content, at any time and without notice. We try to keep the Site available, but we cannot promise that it will always be available or free of errors, and we are not liable if it is not.
13Ending your use of the site
These Terms apply for as long as you use the Site. We may suspend or end your access to the Site, or remove anything you have posted, at any time and without notice, if we reasonably believe you have broken these Terms or the law. If we do, you must not try to return under another name. We may also take any other legal action open to us.
14Corrections
We work to be accurate, and we correct our mistakes openly, as our Editorial Policy explains. We may correct or update anything on the Site at any time without notice.
15Disclaimer
THE SITE AND THE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. YOU USE THEM AT YOUR OWN RISK. TO THE FULLEST EXTENT THE LAW ALLOWS, WE GIVE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR ANY ERRORS OR OMISSIONS IN THE CONTENT; ANY UNAUTHORISED ACCESS TO OUR SERVERS OR THE INFORMATION ON THEM; ANY INTERRUPTION OF THE SITE; ANY VIRUS OR HARMFUL CODE PASSED TO OR THROUGH THE SITE BY ANYONE ELSE; OR ANY PRODUCT OR SERVICE OFFERED BY AN ADVERTISER OR ANY OTHER THIRD PARTY. NOTHING ON THE SITE IS PROFESSIONAL ADVICE. OUR DISCLAIMER SAYS MORE.
16Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER WE NOR OUR DIRECTORS, EMPLOYEES OR AGENTS WILL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFIT, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SITE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. WHATEVER THE CLAIM AND HOWEVER IT IS BROUGHT, OUR TOTAL LIABILITY TO YOU WILL NEVER BE MORE THAN THE AMOUNT, IF ANY, YOU HAVE PAID US. SOME LAWS DO NOT ALLOW THESE LIMITS. WHERE THEY APPLY TO YOU, SOME OF THESE LIMITS MAY NOT, AND YOU MAY HAVE ADDITIONAL RIGHTS. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.
17Indemnity
You agree to defend and compensate us, our companies and our officers, staff, agents and partners for any loss, damage, liability, claim or demand, including reasonable legal fees, made by anyone else because of: your Contributions; your use of the Site; your breach of these Terms or of the promises you have made in them; or your breach of anyone else’s rights, including intellectual property rights. We may take control of the defence of any such claim at your expense, and you agree to cooperate with us. We will tell you about any such claim when we become aware of it.
18Electronic communications
When you use the Site, email us or fill in a form on the Site, you are communicating with us electronically. You agree that agreements, notices and other communications we send you electronically, by email or on the Site, meet any legal requirement that they be in writing, and you agree to the use of electronic records and signatures.
19Governing law and disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan.
Informal negotiation first
If a dispute, controversy or claim arises from these Terms or the Site (a “Dispute”), you and we agree to try to settle it informally for at least 45 days before starting arbitration. The 45 days begin when one side gives the other written notice of the Dispute.
Binding arbitration
Any Dispute that is not settled, including any question about whether these Terms exist, are valid or have ended, will be finally resolved by arbitration administered by the International Commercial Arbitration Court of the European Arbitration Chamber (Avenue Louise 146, Brussels, Belgium) under its rules, which form part of this clause. The seat of arbitration will be Pakistan, the language will be English, and the substantive law of Pakistan will apply.
Individual claims only
Any arbitration will be limited to the Dispute between you and us as individuals. To the fullest extent the law allows, no arbitration will be joined with any other proceeding, and no Dispute may be brought as a class action or on behalf of the general public or anyone else.
Exceptions
The following are not subject to informal negotiation or arbitration: any Dispute about enforcing, protecting or the validity of either side’s intellectual property rights; any Dispute about theft, piracy, invasion of privacy or unauthorised use; and any claim for an injunction. These will be decided by the courts of the Islamic Republic of Pakistan, which will have exclusive jurisdiction, and you agree to submit to them. The same courts will decide any Dispute that is found not to be subject to arbitration.
20California residents
If a complaint to us is not resolved to your satisfaction, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at +1 (800) 952-5210 or +1 (916) 445-1254.
21General
These Terms, with the policies they refer to, are the whole agreement between you and us about the Site. If we do not enforce a right, we have not given it up. If any part of these Terms is found unlawful or unenforceable, that part will be removed or limited as little as possible, and the rest will continue to apply. We may transfer our rights and obligations under these Terms to someone else. We are not responsible for any failure or delay caused by events beyond our reasonable control. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and us, and these Terms will not be interpreted against us because we wrote them.
